General Terms and Conditions Act

Below are the General Terms and Conditions Act and conditions of our company D's Watchionary and its website www.swissmanufactures.com, hereafter called SwissManufactures.

Basis

  1. We do not and never will sell or advertise watches.
  2. SwissManufactures is an information collector and publisher. We do not guarantee the accuracy of the information provided by the users, the clients or us. We do not undertake and guarantee that there is no error, missing information, human mistake, computer system failure or any other problem on the website. Our company is not liable for any loss or damage incurred.
  3. SwissManufactures is not liable for any deal, dispute or any offers and/or contracts between users, clients, manufacturers and/or parallel market dealers.
  4. SwissManufactures is not liable for any accidents, loss or damages, or other electronic or computer system error, computer virus related problems in any civil or criminal case caused directly or indirectly by using the information and services provided by our company, this website or by browsing www.swissmanufactures.com. Users and clients must bear their own risks and undertake not to claim our company for any related loss or damages.
  5. SwissManufactures will not reproduce or sell any information provided to us by our users and clients. We respect your rights for privacy and data protection and will not sell or distribute our users’ or clients’ data.
  6. SwissManufactures is not affiliated with any of the watch manufacturers, parallel market dealers or any other company listed on this website.
  7. The General Terms and Conditions Act of SwissManufactures will apply to all orders placed with, and items/information delivered from, SwissManufactures. Any reference to the client’s general terms and conditions is hereby expressly rejected. Any deviations from the present General Terms and Conditions Act are only valid if agreed in writing by SwissManufactures.
  8. We have the right to revise or delete any parts of this General Terms and Conditions Act without giving prior notice to the users and clients. Therefore, the users and clients must review it from time to time to ensure any updated content is noted.
  9. This General Terms and Conditions Act will be governed and construed in accordance with the laws of Switzerland, excluding the conflict of law rules. Any disputes arising out of or in connection with this General Terms and Conditions Act will fall within the exclusive jurisdiction of the courts at the place of our registered office in CH-4052 Basel / Switzerland.

PriceBroker

  1. SwissManufactures offers retail price lists of approx. 50 watch manufacturers from different regions.
  2. The content of our PriceList was taken from official retail PriceList, however, no responsibility is taken for the correctness of this information.
  3. Our standardized PriceList has a maximum of four columns; Model, Reference, Material and Price, but at least two columns are guaranteed; Reference and Price.

Service Fee

  1. SwissManufactures has created four different categories of service fees, they are;
    1. USD 4.95
    2. USD 3.95
    3. USD 2.95
    4. USD 1.95
  2. We can change the categories of service fees on the website without prior notice. However, upon confirmation of the clients’ order by us or www.saferpay.com, the price shall be deemed to be confirmed and not subject to any change.
  3. The unit of currency listed out in our company and used on this website is USD only (United States Dollar).

Secure Order Handling

  1. Orders may be placed online at any time. Upon receipt of an order, SwissManufactures will confirm the order to the client by email, at which point the order is binding for both parties.
  2. When you place an order online you use an encrypted order which goes directly from your computer to ours, then to www.saferpay.com, where you can use your MasterCard or Visa card. This Swiss company has been providing secure internet payment services for many years now and you can check their references throughout the Internet.
  3. Information you provide to www.saferpay.com or to SwissManufactures will not be given away, sold, or used for any other purpose other than for processing your individual order.
  4. SwissManufactures does not provide any alternative payment options for small amounts. For purchases above USD 100.00, feel free to ask for our bank wire details at UBS Ltd. in Zurich / Switzerland. » Contact
  5. The client's credit card statement will list the purchase under the name of www.swissmanufactures.com.
  6. We only request data that is required for use in connection with processing an order or for the purpose of informing users and clients about new developments in the range of PriceList.
  7. Clients must endeavour to keep their member login, user name, and password confidential, and to avoid improper use by any other third party.
  8. SwissManufactures reserves the right to refuse an order without explanation.

Delivery

  1. When Saferpay confirms the client’s payment, SwissManufactures will send, within 24 hours via email, the scope of supply to the client’s email address provided in his order.
  2. The scope of supply consists of the ordered list in the form of a PDF file, which is a standardized version of the original retail price list, some recommendations about the use of the list, and the client’s invoice.
  3. Every email sent from SwissManufactures to the client has a send and read receipt generated, therefore, in case of not receiving delivery of the product, the client is requested to contact us via email not later than one week after order confirmation: info@swissmanufactures.com.

Returns policy

  1. In the unusual event that we send the wrong PriceList or if the PDF file is not readable when you receive it, please contact us immediately for replacement instructions. We will re-send to fulfill your order.
  2. Should SwissManufactures, for any reason, be unable to supply a PriceList for which an order has been accepted, SwissManufactures will refund the customer's money. We shall not reimburse any additional expenses that the customer may have incurred in connection with the order.

Disclaimer for FirstAid, MarketReferee & Comments

  1. SwissManufactures takes no responsibility or liability for anything that happens as a result of reading, viewing or downloading anything on www.swissmanufactures.com or anything contained in subsequent pages.
  2. We are not liable for any loss or damages caused during making, negotiating and/or performing any purchase agreement and/or contract between users, clients, manufacturers and/or parallel market dealers.
  3. Our company hereby declares that users and clients who make, negotiate or perform sales agreement and/or contracts are under mutual agreement voluntarily, it is out of our company’s scope or extent of control. Users and clients must bear their own risks, including the safety of their personal life and property. Our company is not liable for any loss or damages caused by the conduct or fault of users and clients.
  4. SwissManufactures has absolute, unrestricted authority to reject, modify, or delete any information provided by the users or clients without giving prior notification or compensation.
  5. Children under the age of 18 should not send any information about themselves or their friends and should not register for any of our services nor should they make requests to receive further information from SwissManufactures. Should we discover or be informed that a child has registered his/her or another child’s personal details, we will delete such information from our records. SwissManufactures will not intentionally collect personally identifiable information from children under the age of 18.
